This Policy applies to OhThatLive.com and OH THAT! websites, applications, marketplace features, live-commerce experiences and other services that link to this Policy.

Independent websites and services operated by other companies have their own privacy practices.

The information we collect depends on how you interact with OH THAT!, the features you use, the information you choose to provide, and applicable law.

OH THAT! may receive transaction status, payment tokens, partial payment information, payout status or other information necessary to operate the marketplace without necessarily receiving or storing complete underlying financial credentials.

Verification information

Certain features may require identity, business, tax, age, eligibility or other verification.

Where practical, specialized providers may collect and verify sensitive information directly.

OH THAT! may receive verification results, status information, risk signals or information required by law without necessarily receiving or retaining every underlying identification, tax or financial document.

User content

Photographs, videos, livestreams, comments, chat messages, reviews, listings, product descriptions, profile content, show participation and other material you choose to submit or make available through OH THAT!.

Games, contests, promotions, events and research

Information submitted or generated in connection with live games, contests, giveaways, promotions, events, surveys, interviews, research or other programs. This may include registration information, answers submitted, response times, scores, game participation and history, eligibility status, prize status, promotional shopping credits or balances, redemption activity, winner-verification information, and information used to protect game integrity, detect fraud or enforce applicable rules. Not every category is collected in every game or program.

Specific games, contests or promotions may have separate Official Rules or additional terms governing eligibility, prizes and participation.

Depending on the technologies and features in use, we may automatically collect information about your interaction with OH THAT!, including:

Device and technical information

Usage and engagement information

Pages viewed, shows watched, livestream activity, clicks, searches, products viewed, products saved, sellers or creators followed, watchlists, browsing patterns, session duration, referring pages and other interactions with OH THAT!.

Transaction and shopping activity

Purchases, bids or offers if offered, carts, saved products, order activity, seller interactions and other marketplace behavior.

Livestream and media activity

Shows viewed, viewing duration, interactions, chat participation, reactions and other engagement with live or recorded content.

Game activity

If you play or watch an OH THAT! game, information about games played or watched, questions presented, answers submitted, submission and response timing, scores and results, eligibility status, game history, interactions with game interfaces, technical and session information relevant to gameplay, and other game engagement information.

App and mobile information

If OH THAT! offers mobile applications, we may collect information associated with app usage, device permissions, push notifications and similar mobile functionality.

Location information

We may derive approximate location from information such as an IP address.

Certain future features may request more precise location information when useful to provide the feature and where appropriate permission or consent has been obtained.

Diagnostic and performance information

Crash data, error logs, performance data, security events and information used to maintain and improve the service.

For example, a provider may confirm that a seller completed an identity check without OH THAT! needing to retain a copy of the identification document.

We may nevertheless receive or retain information when reasonably necessary to operate OH THAT!, prevent fraud, protect users, process transactions, meet recordkeeping requirements or comply with law.

Please do not send identification documents, complete financial account information, medical information or other highly sensitive information through a general contact form unless we specifically ask you to use an approved process.

OH THAT! is gay-owned and rooted in LGBTQ+ culture, but using OH THAT! does not tell us how you identify.

We do not assume that someone is LGBTQ+ or has any particular sexual orientation, gender identity or other sensitive characteristic merely because that person visits OH THAT!, subscribes, watches a show, buys something, sells something or participates in the community.

People may voluntarily provide information that reveals or relates to sensitive characteristics.

A provider may collect information directly from you.

Depending on the relationship, that provider may process information on our behalf or under its own applicable terms and privacy notice.

OH THAT! may receive status information, verification results, risk signals, transaction information or other information necessary to operate the platform without necessarily receiving every underlying document or credential.

We may send marketing communications where permitted by law.

You may unsubscribe from marketing email using the unsubscribe mechanism provided in the message.

Unsubscribing from marketing does not prevent us from sending necessary transaction, account, security, support, legal or service communications.

Participating in a game, contest or promotion does not by itself constitute consent to receive marketing where applicable law requires separate consent. Optional marketing consent may be requested separately, and you may withdraw it or unsubscribe as provided by applicable law.

We may send non-marketing communications reasonably necessary to administer an account, game, contest, prize, eligibility determination, security matter, transaction or other requested service. Withdrawing from marketing does not prevent necessary game, account, security, prize, legal or service communications.

If OH THAT! introduces SMS, push notifications or other communication channels, additional choices and consent mechanisms may apply.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

OH THAT! may offer features such as profiles, follows, chat, comments, reactions, reviews, watchlists, sharing and other community interactions.

Information you choose to make public or share with other users may be visible to those users and, depending on the feature, potentially to the public.

Think before posting information you do not want others to see.

OH THAT! is built around live and recorded media.

Information associated with livestream participation may include viewing activity, chat, reactions, purchases, interactions and other engagement.

Hosts, sellers, creators, performers and other participants may be recorded under applicable participation agreements.

Public comments, chat or other interactions may appear in recordings, clips or replays where the feature and applicable terms allow.

We retain personal information for as long as reasonably necessary for the purposes described in this Policy.

Retention may depend on:

• the type of information;
• the service or relationship;
• legal obligations;
• transaction and tax requirements;
• fraud prevention;
• security;
• dispute resolution;
• contractual obligations; and
• legitimate business recordkeeping.

For example, certain game-related records may be retained for game and contest administration, winner verification, prize and tax records, fraud prevention, dispute resolution and compliance with Official Rules.

Different information may therefore have different retention periods.

Specialized providers may maintain information according to their own applicable legal and contractual requirements.

If OH THAT! intentionally expands into jurisdictions requiring additional privacy notices, transfer mechanisms, representatives, consent requirements or other protections, we may provide additional disclosures or terms as appropriate.

When OH THAT! intentionally offers games, contests, promotions or other services to residents of Canada or other jurisdictions, additional notices, consent mechanisms, eligibility terms, privacy rights or other protections may apply as required by applicable law. Not all OH THAT! services or promotions are available in every jurisdiction.

OH THAT! is not intended for children.

The general service is intended for people who are at least 18 years old, or the age of majority where they live if higher.

We do not knowingly seek personal information from children through the general OH THAT! service.

Any future feature designed for younger users would require separate review and appropriate protections before launch.

Information may be disclosed or transferred as part of a merger, acquisition, financing, investment, restructuring, bankruptcy, sale of assets or other business transaction, subject to applicable law.

We may update this Policy as OH THAT! evolves.

When we make changes, we will update the “Last updated” date.
